Georgia Criminal History Record Restrictions

O.C.G.A. §35-3-37 provides for the restriction of certain criminal history records for non-criminal justice purposes when approved by the prosecuting attorney. You may be eligible if:

• Arrested in Henry County for a felony charge;
• The offense was not referred to a prosecuting attorney for prosecution;
• The prosecuting attorney does not move forward with the charge or dismisses
the charge;
• The applicant has a first offender / conditional discharge conviction that was
not previously restricted; or
• The applicant has a conviction for certain offenses and meets restriction
criteria.
